Q1. Will I have to leave my home after being charged?
In most cases, yes at least initially. When a domestic charge is laid, release conditions almost always include a requirement to stay away from the shared home and have no contact with the complainant. We work to get those conditions reviewed and changed as quickly as possible.
Q2. What if the complainant no longer wants to proceed?
The charge does not automatically go away. In Alberta, it is the Crown not the complainant who decides whether to continue. That said, a complainant’s position does carry weight in negotiations, and we raise it with the Crown as part of pursuing a resolution.
Q3. Are domestic charges handled differently than other assault charges?
Yes. Calgary has a dedicated Domestic Violence Court with its own prosecutors and process. Bail conditions tend to be stricter, and the Crown applies additional scrutiny. Having a lawyer who knows how this court operates makes a real difference.
